1. General Information
1.1. “T-Shirts” promotion (the “Promotion”) is developed and organized by Dolphin Corp LLC, St. Vincent and the Grenadines company with registration number 915 LLC 2021 and address at Euro House, Richmond Hill Road, Kingstown, St. Vincent and the Grenadines (“We”, “Us”, “Our”).
1.2. Our goal is to enhance the Binomo platform (the “Binomo”, “Platform”) community engagement and build a strong connection with Our subscribers to make everyone feel a member of the Binimo family.
1.3. Promotion terms and conditions (the “Rules”) are available at https://blog.binomo.com/tshirts (the “Promotion Page”, “Our Site”).
2. Who can participate?
2.1. Participation in this Promotion is exclusive and available only to legally capable persons (“You”, “Your”, “Participant(-s)”) who are subscribers to the following Binomo Instagram account https://www.instagram.com/binomo/ (the “Page”) (the “Participation Criteria”).
2.2. These Rules may also have additional requirements for the Participants. Please, review them carefully.
3. When We run the Promotion
3.1. The Promotion runs from September 16, 2024 (00:00 UTC) to September 23, 2024 (23:59 UTC) (the “Promotion Period”).
4. How to participate?
4.1. To take part in the Promotion You need to complete a set of tasks (the “Task(-s)”) during the Promotion Period:
(a) tag a friend in the comments section of the post published on Our Instagram Page on August 18, 2024 (the “Post”); and
(b) share the Post to the Stories in Your Own Instagram account.
Completion of these Tasks counts as a Your entry into the Rewards owners selection.
4.2. Please keep in mind, You can participate in the Promotion only once. We will also count Your participation only once.
5. Rewards
5.1. We have prepared ten (10) branded T-shirts with Mohammed Shami autograph (the “Reward” and “T-shirt(-s)”). If You meet the Participation Criteria and complete all Tasks, You may receive one (1) of them.
5.2. The lucky Rewards owners will be determined by a randomizer – an automated program randomly generating numbers, by September 26, 2024 (23:59 UTC).
5.3. We will announce them in Stories on Our Instagram Page by September 26, 2024 (23:59 UTC), and additionally contact via individual messages (Instagram Direct).
Plese, make sure Your Instagram settings allow You to receive direct messages. Otherwise We will not be able to contact You for the award process and will be forced to cancel Your participation in the Promotion.
5.4. We will send Your Reward within one (1) month after You provide Us with the details necessary for the delivery. We will try to be faster. The time You actually receive it depends on the work of a courier service.
5.5. Please remember, all Rewards are personal. They cannot be exchanged or substituted, including for money.
6. Additional terms
Participation in Promotion
6.1. If You take part in the Promotion and (or) use any Reward provided therein, You fully accept and agree to be bound by these Rules.
6.2. By participating in the Promotion, You act of Your own free will and voluntary decision, in Your own interest and at Your own risk.
6.3. We do not allow Our employees, affiliates, and persons involved in the administration and execution of the Promotion to participate in it. If You hold any of these statuses, We will not count You as a Participant.
6.4. The Promotion is not sponsored, endorsed, managed or affiliated with Meta and (or) Instagram.
These Rules
6.5. These Rules apply specifically to the Promotion and are supplemented to the Binomo Client Agreement (the “Client Agreement”) and Privacy Policy (the “Privacy Policy”) published on https://binomo.com/.
If any issue is not expressly provided forth or covered by these Rules, the provisions of the Client Agreement and Privacy Policy shall apply.
Fraud and abuse
6.6. Any fraudulent actions and other abuses in order to participate in the Promotion and obtain any unfair advantages are not allowed.
Any manipulation, deception, misleading, providing Us false data and information, attempts to bypass the Rules, including through the use of artificial intelligence tools, bots and other similar methods, and other abuses are strictly prohibited.
If You breach this Clause, We may cancel Your participation in the Promotion and demand a full refund of Our losses. In addition, We may refuse to provide You with the Rewards and ban You from participating in any future Binomo promotions.
Changes
6.7. We reserve the right at any time, for any reason and in Our sole discretion to modify, suspend, terminate, restart the Promotion, as well as to shorten or extend its Period without prior notice. We may do this by changing the Rules, removing them from Our Site, restricting and (or) reactivating access to it.
It is Your responsibility to monitor for any changes. Make sure to periodically check Our Site not to miss anything important.
Interpretation
6.8. Wherever We use the words “includes”, “including” or “including”, the words “without limitation” shall be deemed to follow.
The term “day” always means a calendar day unless We expressly set otherwise.
All terms and definitions herein apply equally to the male, female and neutral genders and their singular and plural forms, unless the context clearly indicates otherwise.
Personal information
6.9. By taking part in the Promotion, You expressly and freely agree and authorize Us to collect, process, store and use Your first name, surname, nickname on Your social media account(-s) and online resources (if any), address, telephone, image and other personal data. We will use it to contact You and, if necessary, publish in Binomo social media and online resources channels, groups and communities, Binomo advertising and other materials, including by announcing and referencing them.
You may withdraw Your consent at any time by sending Us a notice at dataprotection@binomo.com.
Security
6.10. You are solely responsible for the security and safety of the credentials of Your accounts (cabinets). All actions and decisions made through them are deemed to be done by You.
Please, make sure that Your data is protected and kept confidential so no third party has access or control over it.
Compliance and liabilities
6.11. You are fully and solely responsible for compliance with any laws and regulations that relate to or mediate Your participation in the Promotion, and for any consequences of such activity, and fully release Us, Meta and Instagram from any related liabilities.
6.12. We assume no responsibility for any financial, tax or other consequences that have arisen or may arise as a result of or in connection with Your participation in the Promotion, receipt and (or) use of the Rewards. We will not be liable for the following cases, among others:
- if You failed to review, misunderstood or misinterpreted these Rules for any reason;
- for any Your errors and their consequences, including inaccuracies in the contact details You provided Us;
- use of Your account(-s) and (or) cabinet(-s) by third parties whether with or without Your authorization;
- if We have not received information about Your participation in the Promotion or data necessary to award with Rewards for any reason, including in cases of Your inactivity, other circumstances on Your side, technical problems and system failures in data transmission, whether on Your, Our or a third party’s side;
- if You have not completed the Tasks or do not meet the Participation Criteria;
- if You have not claimed or used the Rewards.
