Rules of the promotion “SAYYES”

1. General Information

1.1. “SAYYES” promotion (the “Promotion”) is developed and organized by Dolphin Corp LLC, Saint Vincent and the Grenadines company with registration number 915 LLC 2021 and address at Euro House, Richmond Hill Road, Kingstown, Saint Vincent and the Grenadines (the “We”, “Us”, “Our”).

1.2. Our goal is to improve the experience of using the Binomo platform (the “Binomo”, “Platform”) and to increase its Users the loyalty.

1.3. Promotion terms and conditions (the “Rules”) are available at https://blog.binomo.com/rules-of-the-promotion-sayyes/ (the “Promotion Page”, “Our Site”).

2. Who can participate?

2.1. Participation in this Promotion is exclusive and available only to legally capable persons (“You”, “Your”, “Participant(s)”) who:

(a) are registered on Binomo as its Users; and

(b) have indicated India as the country of their residence in Binomo Account; and

(c) are subscribers to the following Binomo Instagram page https://www.instagram.com/binomo/ (the “Page”) (para. (a) to (c) together – the “Participation Criteria”). 

2.2. These Rules may also have additional requirements for the Participants. Please, review them carefully.

3. When We run the Promotion

3.1. The Promotion runs from June 24, 2024 (00:00 UTC) to June 30, 2024 (23:59 UTC) (the “Promotion Period”).

4. How to participate?

4.1. To take part in the Promotion, during the Promotion Period You need to complete a number of tasks (the “Tasks”).

(a) give a “like” (an approving heart-shaped reaction) to a post published on the Page on June 24, 2024; and

(b) complete to Your Binomo Real Account one-time Deposit using the promo code SAYYES. The minimum Deposit amount is specified in the Binomo Client Agreement.

4.2. You may take part in the Promotion one (1) time. We will count Your participation also only once. 

6. Rewards

5.1. Participants who meet the Participation Criteria and complete all Tasks may enjoy to receive one (1) of the following rewards (the “Reward(s)”):

• Royal Enfield Bullet 350 motorcycle or its equivalent (one (1) piece in total in the Promotion);
• Redmi smartphone (one (1) piece in total in the Promotion);
• a cricket bat (a total of nine (9) pieces within the Promotion);
• a cricket ball (a total of six (6) pieces within the Promotion);
• a signed jersey (a total of thirteen (13) pieces within the Promotion).

5.2. Please remember, all Rewards are personalized. They cannot be replaced or exchanged, including for money.

5.3. The lucky ones of the Rewards shall be randomly determined by an automated program – random number generator (randomizer). We will announce them on the Page by July 03, 2024 (23:59 UTC) and will additionally contact them via individual messages (Direct) on Instagram.

5.4. We will be ready to send the Reward to Your address by July 30, 2024. We will try to be faster. The time You receive the Reward depends on the work of the courier service. 

5.5. If We need additional information to deliver the Reward, We will send You a notification by email indicated in Your Binomo Account. Please send Us the requested details within five (5) days, otherwise We will be unable to award You and forced to cancel Your participation in the Promotion.

6. Additional terms 

Participation in Promotion

6.1. If You take part in the Promotion and (or) use any reward provided therein, You fully accept and agree to be bound by these Rules.

6.2. By participating in the Promotion, You act of Your own free will and voluntary decision, in Your own interest and at Your own risk.

6.3. We do not allow Our employees, affiliates, and persons involved in the administration and execution of the Promotion to participate in it. If You hold any of these statuses, We will not count You as a Participant.

6.4. The Promotion is not sponsored, endorsed, managed or affiliated with Meta or Instagram.

These Rules 

6.5. These Rules apply specifically to the Promotion and are supplemented to the Binomo Client Agreement (the “Client Agreement”) and Privacy Policy (the “Privacy Policy”) published on https://binomo.com/.

If any issue is not expressly provided forth or covered by these Rules, the provisions of the Client Agreement and Privacy Policy shall apply. 

Fraud and abuse 

6.6. Registration of new Binomo Accounts by already registered Users, as well as any fraudulent actions and other abuses in order to participate in the Promotion and obtain any unfair advantages are not allowed.

Any form of fraud and abuse, including manipulation, deception, misleading, providing false information and data, as well as any attempts to bypass the Rules, including through the use of artificial intelligence tools, bots and other similar methods, are strictly prohibited.

If You breach this Clause, We may cancel Your participation in the Promotion and demand a full refund of Our losses. In addition, We may refuse to provide You with the rewards hereunder, deduct any benefits and profits You received from or as a result of Your unfair acts, abuses and manipulations, including by adjusting Your transactions and results on Binomo. We may also prohibit You from participating in any future Binomo promotions.

Changes

6.7. We reserve the right at any time, for any reason and in Our sole discretion to modify, suspend, terminate, restart the Promotion, as well as to shorten or extend its Period without prior notice. We may do this by changing the Rules, removing them from Our Site and (or) restricting access to it. 

It is Your responsibility to monitor for any changes. Make sure to periodically check Our Site not to miss anything important.

Interpretation

6.8. Capitalized terms We use in these Rules, such as “Account”, “Real Account”, “Deposit”, “User”, etc., and do not define otherwise shall be interpreted in accordance with the Client Agreement.

Wherever We use the words “includes”, “including” or “including” in this Rules, the words “without limitation” shall be deemed to follow.

The term “day” always means a calendar day unless We expressly set otherwise.

All terms and definitions herein apply equally to the male, female and neutral genders and their singular and plural forms, unless the context clearly indicates otherwise.

Personal information

6.9. By taking part in the Promotion, You expressly and freely agree and authorize Us to collect, process, store and use Your first name, surname, nickname on Binomo, in social media and online resources (if any), Your Binomo User ID, address, telephone and other contact details, Your image and other personal data (the “Personal Information”). We will use it to contact You and, if necessary, publish in Binomo social media and online resources channels, groups and communities, Binomo advertising and other materials, including by announcing and referencing them.

You may withdraw Your consent at any time by sending Us a notice at dataprotection@binomo.com. 

Security

6.10. You are solely responsible for the security and safety of the credentials of Your accounts (cabinets). All actions and decisions made through them are deemed to be done by You.

Please, make sure that Your data is protected and kept confidential so no third party has access or control over it. 

Compliance and liabilities 

6.11. You are fully and solely responsible for compliance with the laws and regulations that relate to or mediate Your activity on Binomo, including on the part of Your participation in the Promotion, for any consequences of such activity, and fully indemnifies Us, Meta and Instagram from any and all related liability.

6.12. We assume no responsibility for any consequences, financial, tax or otherwise, which arise or may arise as a result of or in connection with Your activity on Binomo, participation in the Promotion, receipt and (or) use of the rewards. We will not be liable for, among others:

• if You failed to review, misunderstood or misinterpreted these Rules for any reason;
• any Your errors and their consequences, including inaccuracies in the contact details You provided Us or indicated in your Binomo Account;
• use of Your Binomo Account or other account(s) (cabinet) by third parties whether with or without Your authorization;
• if We have not received information about Your participation in the Promotion or data necessary to award rewards for any reason, including in cases of Your inactivity, other circumstances on Your side, technical problems and system failures in data transmission, whether on Your, Our or a third party’s side;
• if You have not completed the Tasks or do not meet the Participation Criteria;
• if You have not claimed or used the rewards provided.
