Rules of the promotion “DEEPAK”

1. General provisions on the procedure for holding the promotion

1.1.The “DEEPAK” promotion (hereinafter referred to as the “Promotion”) is held in order to promote the Binomo trading platform located on the websitehttps://binomo.com/ (hereinafter referred to as “Binomo,” the “Binomo” platform).

1.2. Participants of the Promotion must be legally eligible individuals who (i) are registered users of the Binomo platform, (ii) have indicated India as their country of residence in their profile (Personal Account) on the Binomo platform, and (iii) are followers of the official Binomo Instagram page https://www.instagram.com/binomo (hereinafter referred to as “Participants”).

1.3. By participating in the Promotion, i.e. by performing the conclusive actions referred to in clause 4.1 of these Rules, the Participants fully agree to these Rules and accept them.

1.4. Participation in the Promotion is free.

2. Information about the organizer of the Promotion

2.1. The Promotion is organized by Dolphin Corp LLC (a company incorporated under the laws of St. Vincent and the Grenadines, registration number 915 LLC 2021, whose office is located at Euro House, Richmond Hill Road, Kingstown, St.Vincent and the Grenadines) (hereinafter referred to as the “Organizer”).

2.2. The website where information about the Promotion can be found is https://www.instagram.com/binomo/ (hereinafter referred to as the “Organizer’s Website”).

3. Promotion Dates

3.1. The promotion is to be held from  11.12.2023 to 17.12.2023 (hereinafter referred to as the “Promotion Period”).

4. Terms and conditions for participation in the Promotion

4.1. To participate in the Promotion, the Participant must:

1. fund their Real Account on the Binomo platform with at least 50 (fifty) US dollars or the equivalent in another currency using the promo code “DEEPAK”; and/or
2. leave (post) under the post dated 11.12.2023 on the Binomo Instagram page https://www.instagram.com/binomo/ a comment in English as follows: “I want a card.”

4.2. Participants can take part in the Promotion an unlimited number of times.

4.3. When determining the results of the Promotion, the participation of one individual is taken into account one time.

4.4. Participation in the Promotion of persons who do not meet the requirements for Participants in accordance with clause 1.2 of these Rules will not be taken into account. 

5. Promotion prize fund

5.1. The total  prize fund for the Promotion consists of 10 (Ten) T-shirts with the Binomo logo autographed by Deepak Chahar (hereinafter referred to as the “T-shirt(s)”), as well as digital cards (images) with the image and autograph of Deepak Chahar on them (hereinafter referred to as the “Card(s)”).

5.2. The opportunity to receive 1 (one) out of ten (10) T-shirts is available to Participants who have fulfilled the condition for participation in the Promotion provided for in sub-clause (a) of clause 4.1 of these Rules. Each Participant who has fulfilled the conditions for participation in the Promotion provided for in sub-clause (b) of clause 4.1 of these Rules will receive 1 (one) Card regardless of whether the condition specified in sub-clause (a) of clause 4.1 of these Rules is met or not. 

5.3. The established prizes are not interchangeable and cannot be exchanged for cash.

6. Procedure for determining the winners of the Promotion

6.1. The winners from among the Participants who have fulfilled the condition for participation specified in sub-clause (a) of clause 4.1 of these Rules will be selected using a random number generator (randomizer) no later than 20.12.2023.

6.2. The total number of winners in the Promotion is 10 (Ten).

6.3. The results of determining the winners of the Promotion will be published on the Organizer’s Website no later than 25.12.2023.

7. Information on the timing and procedure for receiving prizes

7.1. Participants who will be the recipients of T-shirts will be notified by the Organizer of the deadlines and procedures for receiving them, as well as the information to be provided. In order to contact the T-shirt winners, the Organizer will use their contact information provided in their Personal Accounts on the Binomo platform.

The requested information must be provided within 5 (five) calendar days of receiving notification from the Organizer.

7.2. If the Participant does not send the requested information to the Organizer within the established period (clause 7.1 of these Rules), the Organizer has the right to cancel their win and, accordingly, reduce the total number of prize winners.

7.3. A card will be sent to each Promotion Participant who has fulfilled the participation condition specified in sub-clause (b) of clause 4.1 of these Rules via Instagram Direct Messaging. 

7.4. The Organizer is not responsible for the consequences of errors and/or inaccuracies made by the Participant, including but not limited to: incorrect indication of the Participant’s contact information in their Personal Account on the Binomo platform, information necessary to receive the prize, or any other necessary information.

7.5. The costs associated with receiving prizes, including but not limited to the payment of applicable customs, taxes, banking and other fees and charges, shall be borne by the Participant. They undertake to independently perform all necessary actions and legal and administrative formalities related to and/or conditioned by their participation in the Promotion and/or the receipt of prizes. 

8. Additional terms and conditions

8.1. New Binomo accounts may not be created by registered users, and users may not engage in any fraudulent practices to participate in the Promotion.

8.2. The results of Promotion Participants who have violated clause 8.1 of these Rules will not be taken into account by the Organizer.

8.3. By performing the conclusive actions provided for in clause 4.1 of these Rules, the Participant gives their consent to the Organizer collecting and processing their personal information, including their first and last name, Instagram nickname, User ID on the Binomo platform, contact details, address, telephone number, and other data, as well as to transferring their personal data to third parties, including for the purpose of arranging the delivery of T-shirts. In addition, by performing the conclusive actions provided for in clause 4.1 of these Rules, the Participant gives their consent to the publication of their first and last name, Instagram nickname, and User ID on the Binomo platform in Binomo channels, groups, and communities on social media, and in the Organizer’s promotional and other materials.

The Participant may withdraw their consent by sending notification to the email address dataprotection@binomo.com. The withdrawal of consent may result in the inability to transfer the prizes, for which the Organizer will not be held responsible and will not be considered to have violated these Rules.

8.4. The Organizer of the Promotion is not responsible for the following:

1. the inability of Users of the Binomo platform to familiarize themselves with the rules posted by the Organizer;
2. the inability of Participants to familiarize themselves with the list of winners of the Promotion posted by the Organizer;
3. the non-receipt/untimely receipt of the information necessary to receive prizes, through the fault of the Participants themselves or through the fault of communications systems, or for other reasons beyond the control of the Organizer;
4. non-fulfillment (untimely fulfillment) by Participants of the Promotion of the obligations stipulated in these Rules;
5. non-receipt by Winners of prizes through not claiming them or refusing to claim them;
6. any consequences of mistakes made by Participants when participating in the Promotion.

8.5. By performing the implied actions provided for in clause 4.1 of these Rules, the Participant gives their consent to receiving information and messages from the Organizer via Direct Messaging on Instagram. 

8.6. The Organizer has the right to amend these Rules at any time by posting corresponding information on the Organizer’s Website. Persons interested in participating in the Promotion must independently monitor for updates of the Promotion Rules by checking for corresponding changes on the Organizer’s Website.

8.7. By participating in the Promotion, the Participant completely exempts Instagram from liability for the consequences of such participation.

8.8. This Promotion is not sponsored, recommended, or managed by, or affiliated with Instagram.

8.9. By participating in the Promotion, the Participant confirms that the Organizer may include their name (pseudonym/nickname) on Instagram when announcing the results of the Promotion.

8.10. The terms “Real Account” and “Personal Account” are understood as defined in the Client Agreement posted on the website at https://binomo.com/.
